The ongoing debate surrounding the regulation of Artificial Intelligence (AI) has sparked intense discussions, with two major perspectives shaping the discourse. On one side, concerns about AI’s potential to surpass human intelligence and the need to regulate its use for ethical reasons take center stage. On the other side, a political dimension emerges, emphasizing the protection of research and development advancements from falling into the hands of rivals.
The rapid expansion of AI applications across various sectors, including national security, military operations, business competitiveness, and individual privacy, underscores the urgency felt by nations, particularly advanced ones, to establish regulatory frameworks. Notably, the European Union (EU) recently achieved a significant milestone by reaching a provisional agreement on the world’s first-ever comprehensive laws to regulate AI.
The EUAI Act, proposed by the European Commission in 2021, categorizes AI systems into four risk levels, each subject to specific regulations. For instance, AI falling under the ‘unacceptable risk’ category faces a ban with some exceptions, such as social scoring and real-time biometric identification. ‘High-risk’ AI, covering areas like autonomous vehicles and medical devices, undergoes pre-and-post-marketing evaluations before potential commercial release.
However, challenges arise in defining different AI systems and assessing the associated risks. The recent approval of the EUAI Act followed extensive negotiations between EU parliament members and member states, marking a crucial step towards formalizing the law. Once enacted, the EUAI Act will be enforced through the EUAI office, allowing penalties for violators, ranging from 7.5 million euros or 1.5% of turnover to 35 million euros or 7.0% of global turnover. Citizens will also gain the right to file complaints against AI providers.
While the EU adopts a prescriptive, top-down approach to regulate perceived AI risks, other major players like China and the United States have different strategies. China leans towards state-led reviews of algorithms to align with socialist principles, while the decentralized, bottom-up approach in the U.S. involves a patchwork of domain-specific agency actions.
